Welcome to hempleads.com (the "Site"), a website operated by TyDo LLC ("Company," "us," "our," and "we"). TyDo LLC operates HempLeads, a HempAware company. We are committed to maintaining strong privacy protections for the people who use our Site and services (together, the "Services").
This Privacy Policy explains how we collect, use, and safeguard information, so you can make informed decisions when using the Services. HempLeads is a business-to-business service, and the Site is meant for people acting on behalf of a company. By using the Services, you consent to the collection, storage, use, and disclosure of your information as described here.
Types of data we collect
We collect "Non-Personal Information" and "Personal Information." Non-Personal Information cannot be used to identify you, such as anonymous usage data, referring and exit pages, browser and device type, and number of clicks. "Personal Information" means data that allows someone to identify or contact you, such as your name, email address, or phone number, and any other non-public information linked to it.
Children's Online Privacy Protection Act
We do not intentionally gather Personal Information from visitors who are under the age of 13. The Site is intended for business users, not children.
Information you provide to us
Our forms and booking calendar are embedded from GoHighLevel (also known as LeadConnector). We collect what you choose to submit:
- Playbook download: name, work email, company, and company type.
- Free sample request: name, work email, phone (optional), company, website, company type, target customer, target states, and the sample you choose.
- Contact form: name, email, company, your reason for reaching out, and your message.
- Discovery call booking: name, email, phone, and your answers to intake questions about your company. Calls take place on Google Meet.
- Email to us: your name, email address, and anything else included in the email, so we can reply.
We do not offer user accounts, store files for you, or take payments on the Site.
Information collected via technology
- To improve the Services, we may record information your browser sends when you visit, such as the referring URL, browser and device type, pages viewed, campaign tags in the link you followed, and the date and time of access. This may be collected using cookies, which are small text files stored by your browser.
- We may use basic analytics, such as Google Analytics, to understand how visitors use the Site. Analytics services may use cookies to gather information such as pages visited, IP address, a date and time stamp, and the referring site.
- The embedded forms and calendar may set their own cookies so they work properly. Our forms are protected by Google reCAPTCHA, which is subject to the Google Privacy Policy and Terms of Service.
- We do not use advertising retargeting pixels or serve third-party advertising on the Site.
You can block or delete cookies in your browser settings. Some form or booking features may not work without them.
Cookies we use
- Google Analytics (_ga, _ga_*): counts visits and shows us which pages and buttons are used. Kept for up to 14 months. Analytics data is not shared with advertisers.
- Google reCAPTCHA: protects our forms from automated submissions. Set only on pages with a form.
- GoHighLevel / LeadConnector: session cookies that make the embedded forms and booking calendar work.
- Site preferences (hl_a11y): stored on your device, not sent to us. Remembers your accessibility settings.
We do not use advertising or retargeting cookies.
Use of your Personal Information
In general, Personal Information you submit is used to respond to your requests or to serve you better. We use it:
- to send what you asked for, such as the playbook or a free sample;
- to schedule, confirm, and send reminders about discovery calls;
- to respond to your messages and inquiries;
- to send follow-up emails about our services for hemp and cannabis companies;
- to provide improved administration of the Services and perform marketing or data analysis; and
- to keep records, prevent abuse, and meet legal obligations.
Email communications
In compliance with the CAN-SPAM Act, all emails we send clearly state who they are from and how to contact us. Every marketing email includes an unsubscribe link. Use it at any time and we will stop sending you marketing email. If you have trouble unsubscribing, email support@hempaware.com. We may still send non-marketing messages about a request or booking you made.
Text messages (SMS)
If you give your mobile number and consent to text messages, we may send reminders and updates about your booking or request.
- We send text messages only with your consent. Consent is not a condition of any purchase.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to opt out at any time. Reply HELP for help, or email support@hempaware.com.
- We do not share or sell mobile opt-in data or consent with third parties for their marketing purposes. Text messaging information is shared only with the service providers that deliver the messages for us.
Business contact data used in client outreach
HempLeads runs business-to-business cold email and social outreach campaigns for hemp and cannabis companies. To do that, we process business contact information, such as names, job titles, work email addresses, and company details, obtained from commercial data sources and publicly available sources. We use it only to contact business buyers on our clients' behalf about products and services relevant to their work.
If you receive outreach from a campaign we run, you can opt out at any time using the unsubscribe link in the email or by writing to support@hempaware.com. We honor opt-out requests as required by the CAN-SPAM Act and will not contact you again through our campaigns after you opt out.
Use of Non-Personal Information
We use Non-Personal Information to improve the Services and the Site experience, and we may aggregate it to track trends and analyze use patterns.
Disclosure of your Personal Information
As a general rule, we do not sell, rent, or lease information collected through the Site. We may disclose Personal Information as described below.
Third-party service providers. We share information with service providers only so they can provide services to us:
- GoHighLevel / LeadConnector: CRM, forms, booking calendar, and email and SMS delivery.
- Google: Google Meet for calls and, when in use, Google Analytics.
- Vercel: website hosting.
Other disclosures. We may disclose Personal Information if we believe in good faith that it is necessary (a) in connection with any legal investigation; (b) to comply with relevant laws or to respond to subpoenas or warrants served on us; (c) to protect or defend our rights or property, or the rights or property of users of the Services; and/or (d) to investigate or help prevent any violation or potential violation of the law, this Privacy Policy, or our Terms of Use. Information may also be transferred as part of a merger, acquisition, or sale of the business.
Links to third-party websites
The Site may link to other websites, including hempaware.com. We are not responsible for the privacy practices or content of those websites. This Privacy Policy applies only to information collected by us through the Site and the Services. We encourage you to read the privacy statements of other websites before using them.
Your rights regarding your Personal Information
You have the right at any time to stop us from contacting you for marketing purposes, by using the unsubscribe link in any marketing email, replying STOP to a text message, or emailing support@hempaware.com. You can also ask us what information we hold about you, or ask us to correct or delete it. We may need to confirm your identity before acting on a request.
Security of your Personal Information
We implement security measures designed to protect your information from unauthorized access. These measures do not guarantee that your information will never be accessed, disclosed, altered, or destroyed. While we use reasonable efforts to protect your Personal Information, we cannot guarantee its absolute security.
California residents
If you live in California, the CCPA/CPRA gives you the right to know what Personal Information we collect and how we use it, to request a copy or deletion of it, and to not be discriminated against for exercising these rights. We do not sell or share Personal Information for cross-context behavioral advertising, so there is nothing to opt out of. To make a request, email support@hempaware.com with "California privacy request" in the subject line. We will verify your identity and respond within 45 days.
Visitors' GDPR rights
If you are within the European Union, you are entitled to certain information and have certain rights under the General Data Protection Regulation (the "GDPR"). These include:
- We will retain information you provide until one of the following happens: (a) you ask us to delete it, (b) we stop using our existing data providers, or (c) we decide the value of keeping the data is outweighed by the costs of keeping it.
- You have the right to request access to the data we store about you, and to rectify or erase it.
- You have the right to seek restrictions on the processing of your data, to object to processing, and to the portability of your data.
- Where you gave consent to our processing, you may withdraw it at any time, without affecting the lawfulness of processing that happened before you withdrew.
- You have the right to lodge a complaint with a supervisory authority with jurisdiction over GDPR matters.
- We ask only for information reasonably needed to respond to you or enter into a contract with you, and we will not require consent to unnecessary processing as a condition of a contract.
Changes to this Privacy Policy
We reserve the right to change this policy and our Terms of Use at any time. For significant changes, we will place a prominent notice on the Site, and those changes will take effect 30 days after the notice. Non-material changes or clarifications take effect immediately. The effective date at the top of this page shows when the policy last changed.
